Dilbird Real Home Private Limited ("We/Our/Us/the Company") firmly believes in the privacy and the security of an individual’s personal information. This Privacy Policy (the “Policy”) describes the manner in which we use, disclose, transfer and collect Personal Data and/or Sensitive Personal Data or Information (as defined herein below) of the individuals (hereinafter, collectively referred to as “Customer”/ “You”, “Your”) who browse or access the Website or provide information on or through the Website or whose information the Company otherwise collects, receives or processes in connection with the offer and sale of its services (“Services”) and ensure its compliance with applicable laws and regulations.

  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • Biometric information;
  • any detail relating to the above clauses as provided to body corporate for providing service; and
  • any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules.

THE INFORMATION WE COLLECT:

YOUR PERSONAL INFORMATION

Personal Information means and includes all information that can be linked to a specific individual or to identify any individual, such as:

  • name, address, Photo, Date of Birth, Gender, Aadhar number or other identification number, Father’s Name, Mother’s Name, mailing address, telephone number (self and for Parent’s/Guardian’s), email ID, password and educational interests;
  • Details of the residential/commercial/retail unit occupied or owned by you, including block/flat number or floor as relevant to our service records and management systems
  • Information collected through visitor management systems, entry/exit logs, vehicle registration numbers, CCTV footage, biometric records or access card information to ensure safety, security, and operational efficiency of the premises.
  • Information related to maintenance fees, facility usage charges, payments made or due and related transaction records.
  • Your IP address, browser type, device identifiers and usage information collected when you access our digital platforms (such as mobile apps, portals or websites) for availing services or making payments.
  • Information you share with us through emails, phone calls, service requests, grievance submissions, or any correspondence made with our facility management office or support teams.
  • Information about your feedback, complaints or preferences related to maintenance, housekeeping, security or other facility management services.

PURPOSE OF COLLECTION:

We collect and utilize the personal information you provide for various purposes such as including but not limited to:

  • Managing maintenance, billing and facility operations;
  • Communicating with you regarding updates, maintenance schedules or service-related announcements;
  • Addressing complaints, queries and feedback;
  • Verifying your identity to enable website usage, facilitating transactions (including payment processing);
  • To meet any legal or regulatory requirement or comply with a request from any governmental or judicial authority and comply with our legal obligations, policies and procedures, including compliance with relevant industry standards and the enforcement of our Terms and Conditions;
  • To resolve any request, dispute, grievance or complaint raised by you in relation to your use of the website;
  • To detect or monitor any fraudulent or illegal activity on the website and managing your account overall;

The Website is not directed towards minors. We do not knowingly collect personal information from any user who is under 18 (Eighteen) years. If we are made aware that we have collected the personal information of a person below the age of 18 (Eighteen) years, we will take steps to delete the information within a reasonable time frame. If a parent or guardian becomes aware that his or her child has provided his/ her information on the website without their consent, he or she shall contact us for the deletion of such information. THE INFORMATION WE DON'T COLLECT:

A third-party payment gateway provider may need to collect specific financial details from you, such as your credit/debit card number or bank account information (collectively referred to as “Financial Information”). The Financial Information obtained by these third-party payment gateway providers will solely be used for billing and payment processes. These transactions occur through secure digital platforms of approved payment gateways, utilizing encryption to comply with established technology standards.

It is important to note that the verification of Financial Information is solely your responsibility, conducted through an authentication process in which we have no involvement, in any manner whatsoever. Therefore, we assume no liability in connection with this verification process. We are not accountable for the actions or inactions of third-party payment gateway providers nor do we bear responsibility for any breaches of conditions, representations, or warranties made by them. Additionally, we are not obliged to mediate or resolve any disputes between you and such third-party payment service providers. Such Financial Information goes directly to our third party, secure payment gateway and is not retained in our servers at all.

If you choose the option to save your credit/debit card, you shall expressly authorize us to process the indicated details to be used as necessary for its activation and development. The card's security code (CVV or CVC) shall only be used for making the purchase and shall not be subsequently stored or processed as part of the payment details. Consenting to the activation of this functionality means that your data will automatically appear in these fields when making future purchases so you will not have to enter your details again for each new purchase as they will be considered as valid and in place. You can change or delete your cards at any time through the My Account section.

OPT-OUT POLICY AND WITHDRAWAL OF CONSENT:

EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE):

We will not be liable or responsible for any failure to perform or delay in performance of any of our obligations that is caused by or due to events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event shall include any act, event, non-happening, omission, or accident beyond our reasonable control and shall include in particular (without limitation) the following:

  • earthquake, storm, natural disaster, act of God, war, terrorism, armed conflict, labour strike, lockout, or boycott, any acts of nature labour disputes, floods, lightning, severe weather, shortages of materials, rationing, pandemic or epidemic, inducement of any virus;
  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
  • Impossibility of the use of public or private telecommunications networks;
  • Any law, order, proclamation, regulation, ordinance, demand, acts, decrees, legislation, regulations, restrictions or requirement having legal effect of any government or any judicial authority or representative of any such government;
  • Any shipping, postal or other relevant transport strike, failure, or accident.

Our performance shall be deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

DISPUTE RESOLUTION:

These Privacy Policy shall be governed by and construed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of courts, tribunals, fora, applicable authorities at Delhi, India. The place of jurisdiction shall be exclusively in Delhi, India.

ASSIGNMENT:

You may not assign your rights and obligations under this Policy to anyone. The Company may assign its rights and obligations under this Policy in its sole discretion and without advance notice to you.

SURVIVAL:

If any provision or provisions of these Policy shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
